Abstract: This article expresses a point of view regarding the regulation of a value threshold of damage in
the criminal code of offenses of abuse of service. The decisions of the Constitutional Court are
analyzed, but the doctrine, the statistics and the practice of criminal prosecution in the last period are
taken into account. Last but not least, there is an analysis of national and international legislation
regarding the crime of abuse in the service.
