Abstract: This paper aims at studying how elements of negotiated justice specific to common law systems entered into the Romanian criminal procedural law system. It particularly deals with the admission of guilt and about one of its most controversial aspects – the object of recognition. The research concludes that what is recognized within this simplified procedure it is the deed and not its legal classification given by the criminal prosecution bodies.

Abstract: This article proposes a theoretical and practical approach of the criminal profiling and underlines its importance for the criminal investigation domain. The process by which are indicated the personality characteristics of a crime author, taking into account the analysis of the crime scene, various types of personalities of the perpetrators to criminal activity, the statistical data of similar acts can be called “criminal profiling”, although there is no unanimously accepted definition so far.

Abstract: This study represents an in-depth analysis of the rulings of the High Court of Cassation and Justice, by the Panel for clarifying certain legal issues. In actuality, it is about the way in which the Supreme Court ruled when issuing such a decision, respectively the Decision no. 16/2016, the conclusions reached being explained and sometimes criticized. In addition, the study identifies other aspects that receive different classification solutions in the judicial practice, which generates a non-unitary practice in criminal matters.
