Abstract: From a conceptual point of view the author proposes the notions of proper and improper robbery (concepts borrowed from the Italian criminal doctrine),arguing on the different degree of social danger of the two concepts. After a comparative presentation of the improper robbery in the Italian, German, Finnish and Swedish criminal law, in the Romanian Criminal code it is proposed a separate incrimination.
