Committing the offense using acts of cruelty or degrading treatments

Abstract: Acts of cruelty and degrading treatments are factors which incompatibility with democratic society values is consecrated in national and international acts, generating vast jurisprudence. The Romanian Criminal Code regulates these aspects within the aggravating circumstances of the individualisation of punishment, subsequent to the pointing out of an increased and concrete social danger of the offense and a higher dangerous character of the perpetrator. The European Convention on Human Rights, in addition to other international instruments, consecrates the ban of torture and inhuman and degrading treatments.
