Rezumat: Cele mai grave dintre faptele ilicite pe care angajatorul le poate săvârşi împotriva salariatului sunt incriminate de lege ca infracţiuni, iar salariatul are un singur mijloc de apărare: plângerea penală. Pentru ca plângerea penală să aibă eficienţă, să-şi poată atinge scopul, toate sistemele de drept ale lumii prevăd o condiţie esenţială: procurorul să nu fie abuziv. Procurorul abuziv are o caracteristică anume care-l defineşte prin excelenţă: el neagă evidenţa. Tocmai asta s-a întâmplat într-un caz recent: pentru a dispune neînceperea urmăririi penale împotriva angajatorului acuzat de săvârşirea unui concurs de infracţiuni, procurorul a negat ceea ce, potrivit legii, nu poate fi negat.

Abstract: The most serious illegal acts that an employer may commit against an employee are incriminated as crimes, and the employee has only one means of defense: the criminal complaint. For criminal complaints to be effective and achieve their purpose, all legal systems of the world state an essential condition: the prosecutor must not be abusive. The abusive prosecutor has a specific feature, which utterly defines him: he denies the obvious. This is exactly what happened in a recent case: in order to close a case in which the employer was accused of a series of offenses, the prosecutor denied what, according to the law, may not be denied.
