Protection of the waste regime by criminal law. Actual situation in Romania

Abstract: In this paper, the author discusses the main weaknesses of the incrimination provided by article 63 of Romanian Law no. 211/2011, regarding the waste regime, in its actual state, as a result of legislation changes that occurred repeatedly. The paper is structured in three parts. The first part indicates the most relevant legislation changes for article 63 of Romanian Law no. 211/2011 since its entry into force. The second part identifies the inconsistencies of the actual version of the law, focusing mainly on the constitutive content of the crime, while the third part points out the main solutions to the deficiencies previously mentioned, alongside de lege ferenda proposals.
