Rezumat: Cadrul legal incident cu privire la avizul conform al procurorului general al Parchetului de pe lângă Înalta Curte de Casație și Justiție pentru numirea, promovarea și eliberarea polițiștilor în/din funcțiile structurilor de poliție judiciară și încetarea acestei calități. În temeiul dispozițiilor art. 55 alin. (4) din Codul de procedură penală (în continuare C.pr.pen.), atribuțiile organelor de cercetare penală ale poliței judiciare sunt îndeplinite de lucrători specializați din Ministerul Afacerilor Interne anume desemnați în condițiile legii speciale, care au primit avizul conform al procurorului general al Parchetului de pe lângă Înalta Curte de Casație și Justiție ori avizul procurorului desemnat în acest sens.

Titlul lucrării în engleză: The assent of the general prosecutor of the Prosecutor’s Office attached to the High Court of Cassation and Justice as regards the appointment, promotion and release from office of policemen holding positions in the judicial police and termination of the quality of criminal investigation authority for the judicial police
Abstract: The author analyzes the nature of typical or atypical administrative document taking into consideration art. 2 par. (1) c) and i) of the Law no. 554/2004 on contentious administrative matters, the order issued by the general prosecutor of the Prosecutor’s Office attached to the High Court of Cassation and Justice, pursuant to art. 55 par. (4) of the Code of criminal procedure, art. 2 par. (3) and art. 6 par. (1) and (2) of the Law no. 364/2004 on the organization and functioning of the judicial police, as amended and supplemented, by which the appointment to the structures of the judicial police is not approved or the notice of appointment is withdrawn. The author also deals with the possibility to file for appeal against this order before an administrative court apart from the order issued by the Minister of Internal Affairs on the appointment/release from office of a judicial police officer.
