Rezumat: Noul Cod penal a adus schimbări esențiale în ceea ce privește teoria generală a infracțiunii: s-a renunțat la pericolul social și s-a revenit la structura infracțiunii indicată de profesorul Traian Pop la începutul secolului XX.
Din acest motiv am considerat util să publicăm o traducere din doctrina penală germană, principala sursă de inspirație a „Școlii de la Cluj”, ale cărei idei sunt la baza noului Cod penal, intrat în vigoare la 1 februarie 2014.

Abstract: The new Criminal Code has brought essential changes with regards to the general theory of the offence: it was discarded the social danger and returned to the structure of the offence indicated by Professor Traian Pop at the beginning of XX century.
For this reason we have considered useful to publish a translation from the German doctrine, the main source of inspiration of “Cluj School”, of which ideas are at the basis of the New Criminal Code, enforced since 1st February 2014.
