Rezumat: Anterior intrării în vigoare a Noului Cod de procedură penală, Serviciului Judiciar Civil i-a fost solicitat un punct de vedere referitor la dreptul și obligația procurorului de a cere, prin sesizarea adresată instanței civile în temeiul art. 245 alin. (1) lit. c1) din Codul de procedură penală anterior și decizia în interesul Legii nr. 2/2011 desființarea atât a înscrisului principal, falsificat, cât și a actelor juridice subsecvente acestora.

(5) of the same normative law, and the subsequent law is in a connection of causality and interdependence with the main law

Abstract: According to the Constitution and to law no. 304/2004 regarding the judicial organization, republished, with the subsequent modifications and completions, the Public Ministry defends the rule of law, rights and liberties of the citizen. The instruments made available for the prosecutor in view of the achieving it’s constitutional role include means of criminal law, but also civil law. For the society overall, the introduction and maintenance in the judicial circulation of some judicial acts, broadly, as well as instrumentum, and also as negotium, corresponding to the reality and of which legal provisions de imperative that safeguard the public interest constitute an issue that concerns the rule of law. The current study proposes to identify and analyze the instruments of criminal and civil law through which the prosecutor can act, by the mediation of the courts of law, for the purpose of reestablishing the violated legality through the closing of some judicial acts in lato sensu.
