Abstract: In the context of advanced technological evolution and public debate on respect for fundamental human rights in the criminal process, polygraph testing remains a means of proof frequently used in the criminal process, without, however, enjoying a doctrinal debate on the legal framework of this
instrument trial. Therefore, this paper presents a punctual analysis of the legal nature of this
evidence and of its admissibility and reliability in the criminal proceedings, mainly with regard to the
compatibility of polygraph testing with the principle of loyalty of evidence in the criminal
proceedings.
