Abstract: In this study, the author analized the criminal offense of fetal injuring, both in terms of the
applicability of the European Court of Human Rights case-law and in the light of national case-law
and law provisions, and proposes solutions to controversial or unclear problems, as well as some
amendments to the law which criminalises this conduct,
