Abstract: The European Union for year’s struggles with the low percentage of the verdict in fraud cases. The fraudsters are usually not convicted due to different problems in the procedures on both national and central level. The agencies such as Europol, Eurojust, and OLAF are coping with this problem but cannot directly get involved in solving it. Due to the obvious reasons, the European Commission is pushing towards the creation of a new body the European Public Prosecutor’s Office that will be able directly to prosecute the fraud cases without the consent of the national legislative authorities. This, of course, raises many cons especially in the issue of subsidiarity.
