Rezumat: Poziţia Comisiei Europene faţă de problema conflictelor de interese s-a construit pe parcursul ultimilor zece ani, pornind de la negocierile pentru aderarea la UE a României. Una dintre condiţiile care trebuiau îndeplinite înainte de aderare, după cum s-a decis la încheierea negocierilor din 2004, a fost dezvoltarea unui sistem de control eficient faţă de conflictele de interese care să permită aplicarea de sancţiuni descurajatoare.

Abstract: The conflict of interest appears when the public servant has a personal interest which influences or seems to influence the accomplishment of his official attributions with impartiality and objectivity. By incriminating this offence it was aimed the removal of any suspicion concerning the deed of the public servant which is called to fulfill an act or to participate in taking a decision in the virtue of it’s job attribution, and by this it produces a direct or indirect material benefit for himself, spouse, a relative or kinsman up to the II degree inclusively.
