Abstract: In this article, the author presents the Pruteanu v. Romania case.
From the structure and the contents of the article, commentaries are revealed on the plaintiff’s claims (a lawyer by trade) regarding the telephone tapp between lawyer and client, on what the European Court of Human Rights acknowledged, on the necessity of interference in a democratic society, on the protection against abuse and on effective mechanisms of a poteriori control.
In closing, the author draws conclusions with regard to violation of art. 8 from the European Convention on Human Rights for the protection of human rights and fundamental freedoms (regarding the right to respect for private and family life) and with regard to art. 145 from the Penal Procedure Code of Romania (on informing the supervised person).
