Rezumat: Prezentul studiu şi-a propus să atragă atenţia asupra unor inadvertenţe legislative ce există în materia suspendării raporturilor de serviciu, fiind analizate comparativ reglementările statutare ale unor categorii profesionale ce au fost apreciate drept relevante pentru scopul propus. Analiza nu a vizat însă global instituţia suspendării raporturilor de serviciu, ci doar acel segment referitor la suspendarea din funcţie ca urmare a implicării celui suspendat în afaceri penale şi numai acele situaţii în care cel cercetat, suspendat, judecat, a fost declarat în final nevinovat. Aceasta reprezintă o primă parte a studiului. O a doua parte analizează dreptul celui suspendat şi declarat apoi nevinovat de a pretinde daune morale pentru suferinţele la care a fost supus în perioada de suspendare şi pârghiile legale pe care le are la dispoziţie, toate acestea prin prisma jurisprudenţei neunitare în materie.

Abstract: This study aims to draw attention to legislative inconsistencies that exist in the matter of suspension of work, by comparatively analyzing statutory regulations of professional categories which were considered relevant to the intended purpose. The analysis does not have as a target the whole institution suspension of work, only that segment on suspension from office due to involvement of the person in criminal investigation and only those situations where the investigated, suspended, trialed person was declared finally innocent. This is the first part of the study. A second part examines the right of the suspended and then declared innocent person to claim damages for the suffering that has undergone during the suspension period and legal levers at hand, all this through the contradictory jurisprudence on the subject.
