Titlul lucrării în engleză: The introduction of the educational institution as civilly liable party in the civil side of the criminal trial. Case anlysis

Abstract: The case submitted for review raises two issues. First, whether the parents and the teacher responsible for supervising the student can be simultaneously introduced in the civil side of the criminal trial as civilly liable parties in order to be held responsible along with the minor defendant. Second, if the supervising theacher was not identified, can the educational institution be held responsible as liable civilly party instead?

The article describes the legal framework that can be used to hold the parents, the teachers and the educational institution accountable civilly for damage caused by minor students who are criminally responsible. Also, the doctrine and the jurisprudence regarding this subject are presented.

Keywords: civilly liable party; the tort action resulting from a crime; parents; pupils; teacher supervisor; educational institution; the basis of the obligation to supervise.
