Abstract: There are a lot of similarities concerning the criminal liability in comparative criminal labor law, from Romanian law, with legislation from French, Spanish, Japanese law etc, but there are also many differences. Regulatory differences can cause, as a big necessity, the improvement of our legislation, to give more rigor to work rapports and to strengthen discipline and responsibility of the social partners. Harmonization of the states legislation is a necessity which make good social relations, contributing to a greater extent to the protection of the rights of employees.
