Rezumat realizat de redacție: Articolul aduce în prim-plan o problemă controversată având în vedere că dispozițiile privind supravegherea tehnică au fost modificate și completate în mai multe rânduri, având în vedere controversele din practică și din literatura de specialitate, formularea generând interpretări diferite. Analiza are în vedere atât legislația anterioară, cât și cea actuală – noul Cod de procedură penală, cu accent pe dreptul la viață privată și emiterea mandatului de supraveghere tehnică.

Cases and conditions for issuing of technical supervision warrant
Abstract: The article brings to the fore a controversial issue taking into consideration that the dispositions on technical supervision have been amended and supplemented on several occasions, given the controversy in practice and literature, the wording generating different interpretations. The analysis takes into account both previous legislation and the actual one – the new Code of Criminal Procedure, with emphasis on the right to privacy and the issuing of technical surveillance warrant.
