Rezumat realizat de redacție: Acest studiu oferă o imagine amplă a răspunderii penale a persoanelor juridice, astfel cum este prevăzută de noul Cod penal român, pornind de la condițiile angajării acestei răspunderi și mergând la pedepsele aplicabile și la cauzele care împiedică răspunderea penală și aplicarea sancțiunilor. Autorul prezintă în detaliu opiniile exprimate în literatura juridică și, acolo unde există, soluțiile oferite de jurisprudență cu privire la cele mai importante probleme din acest domeniu, precum posibilitatea de a angaja răspunderea persoanelor juridice în calitate de autor pentru infracțiuni cu subiect calificat sau posibilitatea de a cumula calitatea de inculpat și cea de parte responsabilă civilmente.

Penalizing Business Law. View on Criminal Liability of Legal Persons
Abstract: This study offers a broad picture of the criminal liability of legal persons, as provided by the new Romanian Criminal Code, starting from the conditions of engaging such liability and going to the applicable penalties and to the causes which prevent criminal liability and enforcement of sanctions. The author presents in detail the opinions expressed in the legal literature and, where existing, solutions offered by the case law regarding the most important problems in this field, such as the possibility to engage liability of legal persons as author for crimes having a qualified subject or the possibility to cumulate the quality of defendant and that of civil liable person.
