Some considerations concerning the information research institute
Abstract: According to Art. 102, point 108 of Law no. 255/2013 for the implementation of Law no. 135/2010 regarding the Code of criminal procedure and for the modification and completion of some normative acts that include procedural – criminal provisions, „by computer system search or a computer data storage medium, is understood the process of research, discovery, identification and collection. of the evidence stored in a computer system or computer data storage medium, carried out by means of appropriate technical means and procedures, so as to ensure the integrity of the information contained therein”.
The computer search is carried out by:
– Specialists working within or outside judicial bodies – art. 168, paragraph 12
CPP or
– Specialized police workers – art. 168^1 CPP – in the presence of the prosecutor or the criminal investigation body.
The computer search is preceded by the other forms of search, as well as the collection of objects and inscriptions.
