The crime of thwarting the fight against diseases provided by art. 352 of the Criminal Code. The evolution of incrimination and the need to adapt the legislation to the current sanitary conditions
Abstract: The declaration in March 2020 by the World Health Organization of the COVID-19 epidemic as a pandemic, determined the Romanian legislator and the central authorities to proceed to adopt normative acts that, in a convergent way, would contribute to limiting or preventing the spread of the SARS-CoV-2 virus. The sanitary measures were completed with the amendment of the texts that incriminate the crime of thwarting the fight against diseases provided by art. 352 of the Criminal Code, as a means of criminal law intended to prevent, fight and sanction the acts that infringe the social value protected by the criminal law: public health.
