Independence of the prosecutor of the International Criminal Court – indisputable current requirement?

Abstract: This paper aims to emphasize the existing necessity to rethink International Criminal Court Prosecutor’s role in the framework of the international criminal justice system which applies norms of International Criminal Law, International Human Rights Law and International Humanitarian Law in order to fulfill the general goal of the system: sanctioning of the perpetrators who have committed international crimes in national or international conflicts. The dynamics of the ICC Prosecutor’s Office relations with other main bodies of ICC – Pre-Trial Chamber, Trial Chambers, and Appeal Chamber – demonstrates in recent cases, as Afghanistan case, that realities of the international community influence the approach of analysis of the cases in international intergovernmental organizations.
