Theoretical and jurisprudential analysis of the suspended prison sentences and the probation
Abstract: The various types of prison sentences, such as suspended prison sentences or probation offers an extremely useful tool to the judge, in order to choose the most appropriate measure for each offender and to avoid, if possible, the imprisonment. The judge is able t ogive the right amount of importance to the seriousness of the crime, the criminal past of the offender and his foreseeable behavior. The paper aims to analyze, both from a theoretical and judicial point of view, the advantages and the deficiencies of these prison sentences.
