Abstract: The practical activity of achieving justice in criminal procedural law often faces the problem of proving the existence of cases that remove the criminal nature of the act. In this study, the author, based on a critical examination of the literature, draws the criteria that would be the basis for proving the existence of legitimate defense in the actions of the person defending against the attack by an irresponsible person.
