Rezumat: Având în vedere dezvoltarea continuă a societății, evoluția mass-mediei, apariția unor mijloace tehnice tot mai performante, dar și preluarea unei mentalități occidentale din ce în ce mai liberale, dreptul la liberă exprimare dobândește un rol esențial în prezent. Odată cu această evoluție, este imperios necesară toleranța și spiritul de deschidere, acordându-se posibilitatea persoanelor de a-și exprima opiniile în spațiul public sau privat. În anumite profesii, precum cea de avocat, dreptul la liberă exprimare are chiar un rol esențial, iar asigurarea unor mijloace de protecție eficiente este deosebit de importantă, deoarece duce la dezvoltarea sentimentului de siguranță, intimitate, demnitate și onoare, valori esențiale atât într-o societate democratică, cât și în concret în această profesie. Totuși, odată cu exercitarea dreptului la liberă exprimare, pot apărea multiple ipoteze de intruziuni – justificate sau nejustificate – în sfera drepturilor altor persoane, fiind astfel lezată viața privată, reputația sau demnitatea acestora, spre exemplu, prin transmiterea unor informații neadevărate, denigratoare sau confidențiale, în raport de ceilalți participanți la actul de justiție. Așadar, în situațiile în care dreptul la liberă exprimare periclitează drepturile altora, trebuie determinate anumite criterii de analizare în balanță a acestor interese.

Abstract: Considering the continuous development of society, the evolution of the media, the increasingly efficient technical means, but also the taking over of a Western, liberal mindset, the freedom of expression acquires an essential role these days. With this evolution, tolerance and the spirit of openness are imperative, allowing people to express their opinion in public or in private. In certain professions, such as lawyering, freedom of expression plays an essential role, and effective means of protection are particularly important, as this leads to the development of a sense of security, intimacy, dignity and honor, essential values in both a democratic society, as well as in this profession. However, with the exercise of the right to free expression, multiple hypotheses of intrusions – justified or unjustified – may arise regarding the rights of other persons, thus damaging their private life, their reputation or their dignity, for example by transmitting untruthful, degrading or confidential information in connection with other participants in the act of justice. Therefore, given that in some situations freedom of expression can affect the rights of others, there must be determined certain criteria for balancing these interests.
