Rezumat: Studiul de faţă îşi asumă rolul unui studiu introductiv în sensul că se recomandă a fi consultat înainte de abordarea statutului victimei, al persoanei vătămate şi al părţii civile în procesul penal. Recomandarea se bazează pe importanţa delimitării rolului pe care cei trei subiecţi procesuali îl joacă în proces. O lipsă de proprietate a termenilor sau o imprecizie în sfera semantică a acestora generează interpretări neconforme cu raţiunile fondatoare ale modelului de proces penal încorporat în noua legislaţie. Combinând mai multe surse legislative, studiul îşi propune să realizeze o tipologie a secvenţelor procesuale ce conduc la calificarea statutului unei persoane ca fiind victimă, apoi persoană vătămată şi alternativ ca parte civilă. Este convingerea autorului că numai degajând reziduurile de sens inutile este posibilă consolidarea funcţionării efective a cadrului procesual general.

The Victim, the Injured Person and the Civil Party in Criminal Proceedings
Abstract: The present study assumes the role of an introductory study in the sense that it is recommended to be consulted before addressing the status of the victim, the injured person and the civil party in criminal proceedings. The recommendation is based on the importance of distinguishing the role that these three procedural subjects play in
the process. Misinterpreting these terms or an inaccuracy of their semantic scope generates inconsistent interpretations with the very reasons of the model of criminal proceedings incorporated in the new legislation. Combining several legislative sources, the study aims to achieve a typology of procedural sequences that lead to
the qualification of a person’s status as a victim, then as an injured person and alternatively as a civil party. It is the author’s belief that only by removing unnecessary residues of meaning it is possible to strengthen the effective functioning of the general procedural framework
