Abstract:
Compared to the regulation of the 1968 Criminal Code, a novelty is the calculation of the fine by the system of fine days, which, through the mechanism of determining the amount, ensures a better individualization of the concrete punishment applied both in terms of proportionality, expressed in the number of fine days. as well as the efficiency, by determining the value of a fine-day taking into account the patrimonial situation of the convict.
Also as a novelty, the Criminal Code removes the possibility of the court to individualize the prison sentence with which the fine is replaced, explicitly providing that the number of unexecuted fine days is replaced by an appropriate number of days of imprisonment.
The current rules are no longer as clear as to the provisions for deducting from the penalty of the fine the period corresponding to the preventive measures, sometimes the application of the provisions requiring such a deduction is completely ignored.
According to art. 72 para. (2) of the Criminal Code, ”the period in which a person has been subjected to a preventive measure of deprivation of liberty shall be reduced even in case of conviction to a fine, by removing all or part of the fine days”.
Also, according to par. (3): ”In the case of a fine accompanying the sentence of imprisonment, the period during which a person has been subjected to a measure of deprivation of liberty shall be reduced by the duration of the sentence of imprisonment”.
Unlike the replacement of fine days with imprisonment, in the case of deducting the period corresponding to custodial measures from the main penalty of the criminal fine, the law no longer imposes the mathematical equivalence of a day of pre-trial detention / house arrest – a fine day.
In the absence of a provision providing for the mathematical equivalence between a day of pre-trial detention / at home and a day of a criminal fine, in the case of conviction to a fine, deduction of detention, pre-trial detention or house arrest or in part, it is imperative, but the proportion of the deduction of the preventive measure from the penalty of the fine is left to the discretion of the court.
The multitude of solutions in which it is erroneously considered that the deduction of the preventive measure from the penalty of the fine is optional, not the proportion in which this deduction takes place, obliges us to reiterate that in case of conviction to the penalty of criminal fine, deduction of detention, pre-trial detention of the punishment, in whole or in part, is mandatory, a single day of detention may justify the removal in whole or in part of the penalty of the criminal fine.
