Abstract: As regards the institution of “executing the provisional arrest warrant issued in the absence of the defendant”, the new Code of Criminal Procedure took over, to a large extent, the provisions of the previous Code of Criminal Procedure (1969).
The authors analyze the abovementioned institution, highlighting some critical aspects and coming up with some improvements to the new regulation.
