Rezumat: Articolul are ca temă exercitarea funcţiei de procuror şef al secţiei judiciare la parchetul de pe lângă curtea de apel, înfăţişând sistematizarea atribuţiilor inerente acestei funcţii, precum şi modalitatea de punere a lor în practică. Atribuţiile care intră în conţinutul activităţii de conducere a secţiei judiciare sunt organizarea, conducerea şi controlul activităţii de execuţie, propunerea de măsuri pentru desfăşurarea în mod corespunzător a activităţii şi repartizarea lucrărilor.
Atribuţia de organizare se materializează în stabilirea activităţii procurorilor cu funcţii de execuţie. Atribuţia de conducere implică îndrumarea activităţii procurorilor cu funcţii de execuţie şi presupune răspunderea asupra acestei activităţi. Atribuţia de control înseamnă verificarea activităţii procurorilor cu funcţii de execuţie.
Atribuţia de conducere şi cea de control, luate împreună, se analizează în raport cu fiecare dintre atribuţiile care compun activitatea de execuţie. Vom avea, astfel, conducerea şi controlul activităţii de participare la judecarea cauzelor, declarare a căilor de atac împotriva hotărârilor judecătoreşti, examinare a cauzelor de aplicare neunitară a legii şi analizare a cauzelor în care instanţele judecătoreşti au pronunţat hotărâri definitive de achitare, restituire sau trimitere la procuror.

Abstract: The article deals with the exercise of the function of chief prosecutor of the judiciary at the Prosecutor’s Office alongside the Court of Appeal, emphasizing on the systematization of the duties inherent to the function, as well as the way in which they are implemented. The tasks involved in the management activity of the judicial section are the organization, management and control of the execution activity, the proposal of measures for the proper conduct of the activity and the distribution of work.
The organization task is to establish the activity of the prosecutors with execution functions. The management task involves guiding the work of the prosecutors with execution functions and assuming responsibility for this activity. The control task implies checking the work of the prosecutors with execution functions.
The management and control attributions, taken together, are analyzed in relation to each of the tasks that comprise the execution activity of the prosecutors. Thus, we will have the management and the control of the activity of participation in the judicial cases, the declaration of appeals against judgments, the examination of the cases of non-uniform enforcement of the law and the analysis of the cases in which the courts have issued final decisions for acquittal, restitution or dispatch to the prosecutor.
