Rezumat: Pentru a se putea constata încetarea executării obligaţiei de a presta o muncă neremunerată în folosul comunităţii, obligaţie impusă în cadrul suspendării sub supraveghere a executării pedepsei, este necesar ca persoana supravegheată să devină incapabilă să presteze munca, iar incapacitatea să aibă un caracter permanent.
Procedura pentru a se constata încetarea executării obligaţiei de a presta o muncă neremunerată în folosul comunităţii, ca obligaţie în conţinutul măsurii suspendării sub supraveghere, poate fi analizată din trei perspective: subiecţii sesizării, fundamentul în drept al admiterii sesizării şi denumirea actului de sesizare.

Abstract: In order to enforce the termination of the obligation to perform unpaid community service, an obligation imposed in the context of suspending service of a sentence under supervision, it is necessary for the supervised person to become unfit for work and the incapacity to have a permanent character.
The procedure for the termination of the obligation to perform unpaid community service, an obligation imposed in the context of suspending service of a sentence under supervision, can be examined from three points of view: the subjects of the referral, the legal basis for the admission of the referral and the name of the referral.
